Governor Ducey in Arizona has openly expressed support to combat recidivism within the Department of Corrections. And SB 1310 is gaining momentum in the Arizona Senate. It creates a incentive
for Arizona Inmates to seek self improvement while incarcerated and earn early release credits. Now this actually makes a lot of sense and gives an inmate the edge. Although some believe the bill does not go far enough because it only effects certain inmates with certain charges. The bill only applies to those convicted with possession of a narcotic drug , dangerous drug , marijuana or drug paraphernalia. It does not apply to those who are charged with manufacture of a drug or transportation of a drug for sale. And those who are convicted of a violent or serious offense.
This bill receives support when recent HB 2270 got no where within the House of Representatives. Some say that bill was to large and encompassing that currently did not have support. Arizona's policy for early release has long been needing change. Many inmates do attempt to reverse the evil cycle of recidivism by enrolling in classes during incarceration and change their lives. But there also is a lot of discouragement within the system. This bill creates a incentive and motivation for the inmates to return to society and make their lives better.
Now for the alarming results of 2018. 95% of Arizona inmates are violent or repeat offenders. Only 5% are non- violent , first time offenders. http://azsentencing.org/

Facebook says American pride is racist and cracks down.
We here at Legal Beagle Paralegal PLLC do not want to give in to false narratives or conspiracy theories , but recent disturbing news about the Facebook crack down on White Supremacy and nationalism also says nationalism includes American Pride. This is very sad and such a dishonor to our Nation and to those who paid the ultimate sacrifice on the battlefield. To openly claim American Pride is bad and racist puts Facebook at new lows.

Executive Order for Free Speech on College campuses
Today the President signed an Executive Order to ensure students Freedom of Speech is further protected besides the already being guaranteed by United States Constitution. The language of the order will have the Colleges and Universities to self regulate while implementing the Presidential Order. There has been several incidents on campuses where conservative voices have received what is said to be a " clamp down " on conservative speech.
Other language in the order states that non-compliance would result in loss of federal funding. Critics of the Executive Order say that the results of non-compliance is not possible. That the federal funding is already guaranteed.
The catalyst that has seemed to out shine others was a incident that occurred at the University of California , Berkley , when a conservative student was punched in the face for speaking conservative views. As many may know University of California , Berkley has always been a hotbed of political strife.
This was also ordered to combat many colleges or universities Civility Policies , which more so an attempt to silence those who disagree with liberal agendas. For example at San Francisco State University students were punished for stomping on Hamas and Hezbollah during a anti- terrorism rally. After a long drawn out battle the university rescinded disciplinary actions against the students.
Many students who speak out with conservative views are immediately labelled as being " racist " and using " hate speech " , and then penalized via the Civility Policies of the college or university. Several on campus newspapers also receive strict criticism from administrators for some articles printed. If a article does not speak highly of the institution or in line with the institutions agenda , the students responsible are normally bullied to change the article printed or even as drastic by removing those students in charge of the newspaper.

Gerrymandering to be decided by Supreme Court
In June the United States Supreme Court will make its ruling on Gerrymandering that both political parties Democrat and Republican party's have been found to be nefariously re-mapping voting districts to gain the majority. And sadly it has gone to another extreme in North Carolina at A & T University. The campus has literally been split in two. One of the organizations contesting this redistricting is Common Cause. A voting rights organization is one of the plaintiffs in the suit.
With the increase and ability of technology redistricting has become much easier and help manipulate voters political views. The use of social media is the front runner of tools that enable this activity. Last year ( 2018 ) North Carolina and Maryland courts ruled in favor of the challengers siting that the activity was in violation of the First Amendment. It is possible this case could change future U.S. elections.

Mongols Motorcycle Club's case sets the example. Intellectual Property.
After a ridiculous decade long hard fought battle , where some would say a waste of tax payers monies the United States District Court of Santa Ana , California ruled that the Mongols Motorcycle Club get to remain the rightful owners of their Club's back patch and insignia. Federal prosecutors were trying to take the Club's insignia trying to say it was part of the Club's members crimes that were committed over the years and partly the motivation of those crimes. And Defense attorney's for the Mongols Motorcycle Club had a different opinion and argued that it was unconstitutional to take the Club's insignia. Judge David O. Carter ruled that such a forfeiture would violate the Motorcycle Club's First and Eighth amendment. Judge Carter was quoted as stating in his ruling that " The Federal government was attempting collective guilt ". And that " it has never been law in our nation ".
Tyranny has seemed to have lost this one and this case definitely sets precedence for future cases nationwide. Several other Motorcycle Club's have faced similar forfeiture of their cuts ( colors ) for the association of their members crimes and law enforcement attempting to link the two.

HB2270 Lost Cause. Sentencing Reform for Arizona.
A bill that was touted to reform sentencing for Arizona really never had the intended results from the beginning it should have had. After learning of this fact to actually think the intent was to have some reform and make Arizona a more " Rehabilitative State " than a " Retribution State " was short lived. Normally such reform bills would have a signal from the Governor's Office in support of such a bill. We learned the Rep. Walter Blackman never spoke with the Gov's Office or Governor Ducey about supporting the Reform Bill.
HB2270 never even made it to the Committee Hearing to then forward it to the House floor. It seems it was just DOA before it even gained traction. There was several versions of the bill floating around and causing strife but many bills see revision well before they ever become actual law. The bill was said to be retroactive and then it was said it wasn't. Some supporters of the bill used that as a fact to help gain support. In truth Arizona Prison Population and the families effected are so desperate for any type of relief they bite at almost anything that looks to be reform.
Arizona Prison Reform is no small task if you followed this recent attempt. A lot of math goes into it to calculate the sentencing guidelines which is a monster in itself. That is not to say reform is not on the horizon , right now it won't be this session.
